Judge Napolitano Explains Point-by-Point Why Hillary Clinton Now Has a ‘Grave’ Legal ‘Situation’ With Her Private Email Scandal

She basically acted in contravention of the appropriate laws.   How she was not briefed escapes me and how she thought that all those silly rules did not apply also escapes me.  The moment you take custody you become responsible and learn soon to appreciate all those silly rules..

Think of it as a live gun.

Actually having a private email simply adds massively to the risks involved.  So now she faces consequences were real ignorance or incompetence becomes irrelevant.  The hard fact is that a single classified or higher document is a problem.  Almost all service men handle the lowest level of secure documents and that typically includes all training manuals.  Thus document care becomes habitual.

It also becomes habitual in any large enterprise as it must.

Anyway she is now exposed to the nicities of the secrets act or its equivalent and do not think for a second that the Chinese were not reading her mail..

Democratic presidential frontrunner Hillary Clinton faces a “grave situation” legally as her email scandal continues to unravel, Fox News’ Judge Andrew Napolitano said Wednesday.

The biggest sticking point is based on a report that two emails from the former secretary of state’s private server — now in the hands of the Justice Department — were deemed “top secret,” the cable network’s legal analyst said.

While the term is well known, it’s unlikely that most of us are aware of the national security implications of “top secret” — but Napolitano broke it down on “Fox and Friends”:
  • “Top secret” means if the information is revealed, it could cause “grave harm” to national security.
  • “Secret” means revealed information could cause “serious harm” to national security.
  • “Classified” means revealed data could cause “some harm” to national security.

“General Petraeus was indicted, prosecuted and convicted for having confidential — the lowest level — materials in a desk drawer in his house,” Napolitano said before juxtaposing that Clinton reportedly had “top-secret materials” on her home computer server.
